Foster obtains lowest possible federal sentence for client

STATESVILLE, NC–August 7, 2017–Attorney Mark Foster capped two years of representation of a client charged with knowing receipt of child pornography with an excellent sentencing result.  The client faced a guideline sentencing range of 121 to 151 months and the government was seeking 121 months.  The statutory mandatory minimum sentence was 60 months.  Foster’s client was an adult man who has Asperger’s Syndrome, also known as Autism Spectrum Disorder. Foster had his client evaluated by two different forensic psychologists and presented the findings to the court along with a comprehensive presentation of other mitigating evidence.  The sentencing judge found this evidence compelling and granted Foster’s motion to have his client sentenced to the minimum 60 months imprisonment, thereby resulting in a sentence that was less than half that recommended by the U.S. Sentencing Guidelines.
